By booking online, paying, taking delivery and/or signing the contract, the renter declares having read, understood and irrevocably accepted all terms below as an integral part of the agreement. The official version at kanikian.mk/kushtet prevails over any verbal communication.
1. Definitions
«Company» means KaniKian Rent. «Renter» is the natural person booking and using the vehicle. «Vehicle» is the rented ATV/motorcycle. «Rental period» starts at handover and ends at staff-confirmed return. «Documentation» includes ID, licence, phone, email and uploaded photos.
2. Eligibility and identity verification
Renter must be at least 18, hold a valid licence for the category and valid ID. Declared document numbers must match physical documents and online uploads; mismatch is grounds for refusal or immediate termination without refund. The Company may request additional verification and refuse service without obligation to state reasons if fraud or safety risk is suspected.
3. Booking, contract and status
Online bookings are «pending» until staff confirmation. Digital or printed contract plus these terms form the entire agreement. Price, period, vehicle and location (Driven In) are as stated in the contract; changes only with written Company approval.
4. Payment, deposits and security
Payment per tariff at confirmation. The Company may require deposit/security (cash, card hold, guarantee document) to cover damage, fines, delay or unforeseen costs. Non-payment, late payment or refusal of security allows immediate termination and use of deposit for compensation.
5. Handover, inspection and initial condition
Before departure, renter inspects the vehicle with staff, confirming condition, mileage, fuel and accessories (helmet, keys, etc.). Pre-existing damage is recorded in writing/photos. After handover, renter bears full responsibility until confirmed return, except pre-documented damage.
6. Permitted use
Vehicle used only by registered renter, for permitted recreational/tourist purposes, within approved area and hours, obeying all traffic laws and local rules of North Macedonia. Mandatory safety briefing before ride.
7. Strictly prohibited
Prohibited: (a) third-party use, sub-letting or transfer; (b) riding under alcohol, drugs or impairing medication; (c) racing, excessive speed, dangerous stunts, off-road where not allowed; (d) passengers over capacity; (e) technical modifications; (f) removing labels/GPS; (g) unlawful use endangering others. Breach = immediate termination + full financial liability.
8. Safety and protective equipment
Approved helmet, suitable clothing and closed shoes are mandatory. Renter is liable for injuries caused by failure to comply. Company may refuse handover if safety requirements are not met.
9. Civil, criminal liability and indemnity
Renter is fully liable for material damage, injury, death caused to third parties, public/private property damage, administrative and criminal offences during rental. Renter indemnifies and holds harmless the Company, staff and legal owners from claims, fines, proceedings and costs (including legal fees) arising from renter acts or omissions.
10. Fines, interest and expenses
All traffic, parking and administrative fines, towing fees, authority costs and legal defence costs during rental are paid by renter within Company deadline, plus processing fees. Company may pay on renter behalf and invoice with interest/administration until full settlement.
11. Damage, loss, theft and vehicle destruction
Renter is liable for full or partial damage (including glass, plastics, engine, tyres, accessories), loss of keys, theft, fire, flooding, damage from bad roads, collision, fall or misuse, even without third-party fault. Assessment by Company (invoices, service, independent appraisal). Deposits applied without limit; balance invoiced immediately.
12. Accidents and reporting
Any accident, collision, damage or theft must be reported immediately to police (where required) and Company. Renter must not leave scene without permission, admit fault without advice, or destroy evidence (photos, video, witnesses). Failure to report increases financial liability and may void insurance cover (if any).
13. Technical defects and maintenance
No repairs without authorisation. Any defect, noise, smoke or warning must be reported immediately; continued use after known defect is negligence. Company may replace vehicle or terminate rental without compensation if unsafe.
14. Fuel, accessories and return
Return in same functional condition with all handed accessories. Fuel policy as stated at handover (full/same level). Missing items, contamination, special cleaning or minor repairs from negligence are chargeable. Return only at approved point within contract hours.
15. Late return, penalties and Company rights
Late return charged per tariff (extra hours/days, admin fee, recovery transport). Company may report to authorities, block future service, recover vehicle and use contract contact data for debt collection within legal limits.
16. Cancellation and no-show
Cancellation before confirmation may be free or fee per current policy. After confirmation, payments may be non-refundable or partially retained. No-show without notice, refusal after confirmation or abusive conduct may incur 100% charge and future ban.
17. Personal data, photos and evidence
Data processed for booking, contract, safety, debt recovery and legal compliance. Document and vehicle photos used as evidence in disputes. Renter accepts Company retention of records (email, phone, contract) for statutory period.
18. Limitation of Company liability
Company not liable for damage from unlawful use, renter negligence, force majeure or hidden defects not visible on inspection. Maximum Company liability, where permitted by law, limited to rental amount paid for that booking, except wilful misconduct or mandatory statutory liability.
19. Force majeure
Company not liable for delay or inability due to extreme weather, disasters, war, strikes, technical failure or government orders. Partial refund or rescheduling at reasonable Company discretion.
20. Governing law and disputes
Laws of North Macedonia apply. Disputes first negotiated; failing agreement within 15 days, competent court at Company location. Renter accepts jurisdiction of that court.
21. Amendments, validity and entire agreement
Terms may be updated at kanikian.mk/kushtet; version at booking/confirmation applies. Invalid clause does not affect others. These terms, contract, inspection and confirmed email/SMS communications form the entire agreement.
